Thank you for visiting the Chuze Fitness website (the “Site”).  Chuze Fitness respects your privacy. This Privacy Policy explains our privacy practices, the manner in which we may collect, use and disclose personal information which you provide to us, and the choices you can make about how your information is collected and used.  By visiting this Site or otherwise providing us with your personal information, you agree to be bound by the terms of this policy.

Collection and Use of Personal Information

Information you or others provide us. We may collect personal information that you provide to us or that is otherwise provided to us on your behalf. You may choose to provide certain personal information in order to access or use certain features or services of the Site, such as making a purchase, joining one of our clubs, paying your membership fees, requesting information, filling out an employment application, entering a contest or otherwise contacting us. Such information may include your name, phone number, e-mail address, mailing address, credit card or banking information or other information. You can always choose not to provide information, but it may limit your ability to use a particular service or feature on the Site.

By providing your personal information to us, you are authorizing us to collect, use and disclose such information in the manner outlined in this policy. We may use your information for our general commercial purposes such as to improve our Site, grow our business and to offer our own, our affiliates’ or third-party products or services that we think you may find of interest.

We may use your contact information to periodically send you newsletters, e-mails or similar communications featuring sales and promotions, news about new Chuze Fitness products and services, requests for your feedback, or other information we think may be of interest to you  You may stop receiving marketing communications from us at any time by following the instructions included in the message you received.

Automatically collected information. Chuze Fitness also automatically collects information sent by your web browser. The information we receive depends upon your browser’s settings. This information typically includes your computer’s IP address, the address of the web page you were visiting when you accessed our Site, the name of the operating system installed on your computer, the name and version of the browser you are using and the date and time of your visit. We use this information primarily to create statistics that help us improve our Site and make it more compatible with the technology used by our visitors. We may link this information with your personal information as we deem necessary for our business purposes. If criminal activity is suspected, we might need to share certain information with the appropriate investigative authorities. Such information may contain visitors’ IP addresses and other information which could be used to trace and identify individuals.

So-called “cookies” and other similar technologies may be used on the Site and by third parties to collect information about a Site visitor’s online activities over time and across third party websites, to support the Site’s functionality and to improve user experience. Disclosure of Personal Information

Chuze Fitness will not disclose, trade, rent, sell or otherwise transfer your personal information except as set out herein, with your consent or as required or permitted by law.

Chuze Fitness may disclose your personal information:

  • To our third party service providers, vendors or agents who provide services to or on behalf of Chuze Fitness or its members such as, but not limited to, hosting, data management and storage services, marketing assistance, operating our online store and payment processing, sweepstakes providers, and retention services. Either Chuze Fitness or such third party service provider may use servers for such purposes located in the United States or another foreign country. Your personal information may be processed and stored in the United States or such other foreign country and the governments, courts, law enforcement and regulatory agencies of that country may be able to demand disclosure of personal information pursuant to the laws of such country.
  • To current and future parent companies, subsidiaries and affiliated entities of Chuze Fitness;
  • To Chuze Fitness franchisees;
  • To help complete a transaction for you;
  • In connection with a merger, sale of assets, corporate reorganization or similar business transaction involving Chuze Fitness, its parents, subsidiaries, affiliates or one or more of its franchisees;
  • To comply with the law, applicable regulations, governmental and quasi-governmental requests, court orders or subpoenas, to enforce our Terms of Use or other agreements, or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection etc.);
  • If the information is already on the public record and the disclosure is directly related to the purposes for which it was recorded on the public record; or

Your Choices

If you do not wish to receive promotional communications from us in the future, you can “opt-out” by following the “unsubscribe” instructions in any communication you receive from us. Please be aware that you are not able to opt out of receiving communications about your account or your transactions with us.

Access to your Personal Information

You are required to provide us with accurate and up to date information. Chuze Fitness gives you the ability to update or change your information at any time by accessing your account on the Site. You have a right to challenge the accuracy and completeness of your personal information and to have it corrected, as appropriate. If you believe your information is inaccurate or incomplete, please access your account and correct or complete it. You may also have a right to request access to your personal information and receive an accounting of how that information has been used and disclosed, subject to certain exceptions prescribed by law. If your request for access is denied, we will notify you in writing of the reason for such denial. To request access or to amend your personal information, please visit your home club.

Security

We have administrative, technical and physical safeguards in place to protect information we collect from loss, misuse, unauthorized access or disclosure, alteration or destruction. We may use a third party to perform secure payment processing for us. Unfortunately, no data transmission over the Internet can ever be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Chuze Fitness cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

You also play a role in protecting your information. You should keep your username and password confidential. If we receive any instructions using your log-in information we will consider that you have authorized the instructions. You can change your password at any time by visitng your account page.

International Transfers

Chuze Fitness may process and store your information on servers located in the United States or in another foreign country where the laws regarding data protection may be less stringent that the laws in your country. The governments, courts, law enforcement and regulatory agencies of that country may be able to demand disclosure of personal information pursuant to the laws of such country. By using this Site and by providing any personal information to the Site, all users, including those in Canada and the European Union, fully understand and consent to the collection and processing of such information in the United States.

We may provide links to other websites that are not affiliated with us. We do not have control over such third parties’ use and handling of your personal information and we are not responsible for their privacy procedures. Use of this Site by Minors

This is a commercial website intended for use by individuals that are at least 18 years old. If you are less than 18 years old, you may not use this Site without the prior permission and supervision of your legal guardians. Chuze Fitness does not accept members under the age of 13 and does not knowingly collect information from anyone under the age of 13.

Terms of Use

Your use of this Site and any issues relating to this policy are subject to Chuze Fitness’ then-current Terms of Use, which are located on our Site.

Privacy Policy Updates

We reserve the right to update or modify this policy at any time and from time to time without prior notice by posting a revised version of the policy on the Site. If we make material changes to this policy, we will endeavor to notify users by means of a conspicuous notice on our homepage. Your use of the Site or any Chuze Fitness facility following any revision to the policy constitutes your agreement that all personal information collected from or about you after the revised policy is posted will be subject to the terms and conditions of the revised policy. The date listed above indicates the most recent change or update to this policy.

Your California Privacy Rights

This section describes certain rights available to you if you are a California resident (the “California Notice”) and is effective as of January 1, 2020.  When we refer to personal information in this California Notice, we mean any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual that interacts with us, through use of our Sites or otherwise.

Chuze Fitness does not sell your personal information for monetary compensation. We may allow certain third parties such as advertising partners to collect your personal information via automated technologies like “cookies” and “web beacons” on our Sites, or share your personal information with certain affiliated companies or promotional partners, in exchange for non-monetary consideration such as an enhanced ability to serve you content and advertisements that may be of interest to you.  These disclosures may be considered a “sale” under California law. You have the right to opt out of this disclosure of your information, as detailed in this California Notice. We do not sell personal information of individuals we actually know are less than 16 years of age

How to Submit a CCPA Request: To submit a request under the CCPA, please visit and complete our privacy request web form at https://www.chuzefitness.com/privacy-request. You may also manage your browser preferences by adjusting your browser settings.  To learn more about the “sale” of your personal information and how you can manage your browser preferences, visit https://www.chuzefitness.com/dns-request. If you choose to exercise any of your rights under the CCPA, you have the right to not receive discriminatory treatment by us.

We encourage you to use this web forms to submit your request, but you may also make a request using our toll-free number at (619) 780-0141 or in one of our California Clubs. You may submit your request through an authorized agent; however, if you designate an authorized agent, we will require you and/or the authorized agent to provide to us written proof of their authorization to act on your behalf. We will acknowledge receipt of your request for disclosure or deletion within 10 days and will endeavor to respond within forty-five days of receipt of your request, but if we require more time (up to an additional forty-five days) we will notify you of our need for additional time. For requests that we not sell your information we will comply with your request within 15 days. We cannot respond to your request or provide you with personal information if we cannot verify your identity and confirm that the personal information relates to you.

For requests for a copy of the personal information we have collected during the 12 months prior to your request we will endeavor to provide the information in a format that is readily useable, including by mailing you a paper copy or providing an electronic copy to your registered account, if you have registered an account with us.

For requests for deletion of your information please understand that California law permits us to retain certain information and not to delete it under certain circumstances.  By way of example, we are not required to comply with a request to delete information if the information is necessary for us to complete a transaction for you or otherwise perform a contract; to detect, protect against, or prosecute security incidents, fraud or illegal activity; to use the information only internally in ways reasonably aligned with your expectations as our customer (such as maintaining sales records), and to comply with legal obligations. If we receive such a request from you we will notify any service providers we have engaged to delete your information as well. Verifying Requests: To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your request.  In order to verify your identity when you request access to or deletion of your personal information, we may require you to provide certain information which we can match to information we  already have on-file about you based on the type of relationship you have with us, such as your member ID and date of last check-in if you are a Chuze Fitness member, or your email address and Chuze Fitness Club visited if you are a guest or non-member.

In addition, if you exercise your right to request specific pieces of your personal information or to delete your information  we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

Shine the Light Requests: You also have a right to request that we provide you with (a) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (b) the identity of those third parties. You may make one request per calendar year, and the information may be provided in a standardized format which is not specific to you individually. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. Erasure Requests: If you are a California resident under the age of 18 and a Chuze Fitness member with a digital account, you may request and obtain removal of content or information you have publicly posted on the Sites. To make this request, please email us at [email protected] and include a detailed description of the specific content or information you would like to remove. Please note that this removal does not ensure complete or comprehensive removal of the content or information posted on the Sites by you as there may be circumstances in which the law does not require or allow removal.

Your California Privacy Rights

California Civil Code § 1798.83 permits residents of California to request from Chuze Fitness a notice disclosing: (1) the categories of personal information we have shared with third parties, if any, for the third parties’ direct marketing purposes, during the preceding calendar year, and (2) the names and addresses of those third parties.
